Terms of Service

1. Agreement

These Terms of Service govern your use of pramtaraspace.org and the Pramatra Space quantum-safe networking platform (together, the "Service") operated by Pramatra Space Private Limited ("the Company"). By accessing or using the Service, you accept these Terms. Nothing in these Terms limits your statutory rights under the laws of your country of residence.

The Company provides satellite quantum key distribution infrastructure and AI-orchestrated key management services to authorised operators. If you are accessing the Service as a representative of an organisation -- a bank, grid operator, government entity, or other institution -- you represent that you have authority to bind that organisation to these Terms.

2. Use of the Service

• You must be of legal age in your jurisdiction or have the authority of the organisation you represent.
• You agree to use the Service only for lawful purposes consistent with applicable law, including applicable Indian telecommunications and information security regulations.
• You agree not to attempt unauthorised access to any part of the Service, any network node, or any cryptographic key material not provisioned to you.
• You agree not to interfere with the integrity or availability of the key distribution network, including by attempting to inject, replay, or modify quantum key exchange sessions.
• You may not reverse-engineer, decompile, disassemble, or attempt to derive source code from any component of the Service except as expressly permitted by mandatory law.
• You may not scrape or copy content from this website or the platform in bulk except for the purpose of integration with your own infrastructure using the documented API.

3. Intellectual Property

The Service, including the satellite QKD platform, the AI routing layer, the ETSI QKD API implementation, the KMA appliance software, and all documentation, is owned by the Company or its licensors and is protected by applicable intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service solely for your organisation's internal network security purposes as described in your service agreement or pilot agreement with the Company.

4. Operator Data and Configuration

You are responsible for the accuracy of any configuration, node parameters, or integration data you submit. You grant us a limited licence to use, store, and process operator data to provision, operate, and maintain the Service for your deployment. Network telemetry generated by your deployment remains subject to the data handling terms in your service agreement. The actual quantum-derived key material distributed through the platform is never stored on Company servers after delivery.

Operators who deploy the Pramatra Space platform remain solely responsible for their own compliance obligations under applicable sector-specific regulation -- including, for financial institution operators, applicable Reserve Bank of India and SEBI information security requirements, and for government network operators, any applicable national security and communications regulations.

5. Disclaimers

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties to the maximum extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Service will be free from interruption or error, or that any particular cryptographic guarantee will meet the requirements of every applicable regulatory framework.

Mandatory warranties applicable in your country of residence are not affected by this disclaimer.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Service will not exceed the amount you paid to the Company in the 12 months immediately preceding the event giving rise to the claim, or USD 100, whichever is greater, except for liability that cannot be limited under mandatory law. The Company will not be liable for indirect, incidental, special, or consequential damages.

7. Indemnification

You agree to indemnify and hold harmless the Company and its officers, employees, and contractors from any claims, losses, damages, or costs (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law or third-party right.

8. Termination

We may suspend or terminate your access if you breach these Terms or if required by applicable law. Sections 3, 4, 5, 6, 7, 9, and 10 will survive any termination.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Disputes are subject to the non-exclusive jurisdiction of the competent courts in Bengaluru, India, without prejudice to any mandatory consumer-protection rights applicable in your country of residence.

10. Changes and Contact

We may update these Terms. Material changes will be posted with a new "Last updated" date. Continued use of the Service after the effective date of any change constitutes acceptance of the revised Terms.
